Protected Health Information (PHI): Privacy, Security, and Confidentiality Best Practices

Health Insurance Portability and Accountability Act (HIPAA) safeguards patients against the mishandling of the patient-protected health information (PHI), which could cause certain damage to their insurability, employability, and/or privacy (Isola & Al Khalili, 2023). Patient privacy is something that gives an individual control of access to their own records, and security is something that involves implementing technical and administrative measures to ensure unauthorized disclosure. To safeguard the information of residents, the paper will consider the connection between compliance and best practices in PHI privacy, confidentiality, and security, and the actions of skilled nursing facilities and the social media policies of these establishments.

Confidentiality Laws in Healthcare

The PHI refers to any information that can be used to identify an individual (medical or treatment history, diagnosis, and any other data) and obtained or used by a medical professional, such as a professional who provides services in a skilled nursing facility (SNF). HIPAA should safeguard PHI to prevent the infringement of the privacy, safety, and confidentiality of patients (Edemekong et al., 2025). Privacy gives the patient the right to determine with whom they want to share their health information; an SNF patient might not wish to disclose the fact that they are sick (Tariq and Hackert, 2023). The issue of security relates to the protection of electronic PHI through encryption, passwords, and a firewall.

Confidentiality gives the assurance that only individuals with a valid clearance have access to sensitive data (The Knowledge Academy, 2025). Privacy issues may arise accidentally during social media activities in SNFs, e.g., posting pictures of residents in care. The risks demonstrate that there is a need to work with people of different professions, train on HIPAA regularly, and adhere to the standards. Shared responsibility is paramount to the protection of PHI, so it is especially important in situations where electronic systems and online platforms become extremely widespread in care facilities.

Interdisciplinary Collaboration Safeguards ePHI

The importance of interdisciplinary teamwork and the role of interdisciplinary teamwork in safeguarding the electronic health information in SNFs is also important. Nurses, social workers, therapists, IT experts, and administrators build safety measures that combine clinical measures with technical protective measures. It should include the right to access to electronic health records, safeguarding encrypted data during storage and transfer, and conducting regular audits of adherence to it (Stefan et al., 2024). Since these measures are implemented as part of regular processes, such as admission to discharge, privacy and security will be part of the routine of doing business, minimizing the potential accidental disclosure.

The same collaborative approach is important to the control of social media risks in SNFs. The clinical personnel can detect sensitive information, HIPAA regulations can be read and interpreted by compliance officers, and IT departments can be implemented to track and/or prevent unauthorized distribution. Cross-disciplinary training aids personnel to be conversant with the policies in the facility, proper consenting practices, and red flag indications (Nzimakwe & Utete, 2024). All these measures put together preserve the confidentiality of the residents, develop trust, and keep the facility within the legal and ethical practices.

Evidence-Based ePHI Risk Mitigation

Some of the evidence-based strategies that healthcare facilities implement to reduce the risk of ePHI include the introduction of clear social media policies, consistent interdisciplinary training on HIPAA, and the ability to monitor unauthorized activity (Secure Frame, 2023). Privacy by design is implemented with the use of encryption of data that is stored or transmitted, role-based access control, and periodic audits (Amod, 2024).

There are also policies and procedures in place to protect identifiable health information, establish violations, and impose either civil or criminal penalties (Edemekong et al., 2024). Other precautions are multi-factor authentication, limited access to authorized employees, anomaly tracking, and encryption of PHI when passing through email, eFax, or text messaging, which enhances security (Amod, 2024). Due to the large number of breaches being a result of human error, ongoing staff training is placed in focus to increase awareness and responsibility.

Example

Today, in Atlanta, several nurses at the Emory University Hospital Midtown are out of service as a video was leaked on social media, in which they were found to disparage labor and delivery patients, which was considered to be a significant privacy invasion (Jackson, 2022). Similarly, the nursing assistant was terminated and sentenced to 30 days in jail after they uploaded a video of a patient on the Internet without their consent (Alder, 2025). These scenarios are examples of the devastating impact of the irresponsible use of PHI on the internet, such as loss of employment and license suspension, criminal and legal actions, and fines by the court.

Even medical institutions receive fines in those situations when the infringement of social media leads to the loss of patient privacy. The example of the University of Rochester Medical Centre that had settled on paying an amount of 3 million dollars because it was discovered that PHI had been given out inappropriately by losing an unencrypted flash disk and stealing an unencrypted laptop. Elite, a privately-owned dental practice, is another example, as it has agreed to pay out $10,000 in response to the reviews posted to the social media site (Secure frame, 2023).

Interprofessional Staff Update

To maintain patient confidentiality and comply with HIPAA, all personnel in any area of operation should follow safe laws of social media usage, both individual and organizational. Actions which are forbidden include: Dear team, the actions which are forbidden include:

  • Do not photograph, record videos, or audio of residents: Do not photograph, record videos, or audio of residents during care, therapy, or daily activities without relevant authorization and written consent.
  • No use of online discussions of patient cases: Do not discuss patient cases, clinical and facility operations on online discussions, in closed groups or chats.
  • Personal devices: Do not access and/or use personal devices to take and/or share patient-related material within the working environment or facility premises.
  • Do not respond to patient reviews and complaints online: Do not respond to online postings of comments and complaints that reveal the safeguarded health data.
  • Do not befriend, follow, or privately message patients or their family members: It is the use of personal accounts to befriend, follow, or privately message patients or their family members, as this places the boundaries of professionalism at risk.
  • Do not label, name, or describe the facility or its residents: Do not label, refer to, or otherwise describe the facility or its residents to breach confidentiality or damage the reputation of the organization.

Social media professionalism maintains the rights of residents, prevents costly HIPAA violations, and maintains confidence in the care environment. It is the duty of all interprofessional team members to use personal and facility social media in line with legal, ethical, and organizational standards.
